Given the limited nature of legal services authorized under Rule 6.5, the conflict of interest rules apply only if the lawyer knows that representing the client involves a conflict of interest or that another lawyer affiliated with the same firm is disqualified because of a conflict of interest. Since the names of the client and any person who disagrees with the client`s subject matter are provided, a lawyer can ensure that the question is not answered once it is known that a conflict of interest exists. If, based on the information provided by the client – whether it is the client`s name or the details of the question – the lawyer determines that there is a real conflict of interest that prevents him or her from responding, he or she must return the question to the available queue. If the attorney has already responded to the client, he or she should contact the NH State Administrator to refer the matter to another volunteer attorney. If the matter goes beyond a one-time consultation under Rule 6.5 (see above), the lawyer is required to conduct a conflict of law check.
